Terms and Conditions and Risk Disclosure Statement

Hire and Tour Liability:

Bicycles; Equipment Hire Conditions:

  • The hirer is responsible for all hired items provided by Top Trail for both themselves and any other rider included in their tour group during the period of responsibility.
  • The Hirer accepts that they are responsible for the cost of replacement, repair or other remedy should any loss or damage occur to hired items during the period of responsibility, unless optional insurance has been purchased through us.
  • The hirer is required to use the supplied lock to ensure the security of our bike or e-bike while in their possession

Tour Terms and Conditions – Booking and Payment

Bike Hire and Shuttles

  • For each rider full payment of the service is required prior to departure.
  • For group bookings of 10 or more full payment is required 7 days prior to departure.
  • No reservation shall be confirmed between Te Wahapu Trading Co Limited T/A Top Trail and the customer until payment has been made and acknowledged in writing by Te Wahapu Trading Co Limited T/A Top Trail
  • In the event of a cancellation of the group reservation within two (2) days of departure, no refund will be made, and for periods longer, a credit or refund of the reservation, less a $25.00 booking fee for each person travelling will be made.
  • We happily will make changes on your reservations however, admin fees may apply depending on the amount of time spent for multiple changes.
  • Combo Tour Packages including accommodation will require a Change to ‘25% deposit at the time of booking, the balance being due 14 days prior to departure
  • Cancellation by the client within 14 days of departure are non-refundable.
  • Credit card payments may attract a 2.5% surcharge.
  • The company reserves the right to cancel any tour if minimum numbers have not been reached or for reasons beyond our control. In this event, we will provide a full credit to ride again or refund.
  • The company reserves the right to decline to accept any participant or hirer at any time.
  • The company reserves the right to amend services or prices should it become necessary in either the interests of safety or unforeseen circumstances, particularly if we deem it is unsafe for a customer to ride for reasons of health or riding ability. We undertake to advise clients as soon as possible of any changes to service, schedule, or price.

Risk Disclosure Statement

Cycling can be an adventurous and rewarding activity, but like all outdoor recreation, they carry inherent risks. Our goal is to provide a safe and enjoyable experience. However, it is important that you understand the nature of the activity and accept the risks before participating.

Inherent Risks May Include (but are not limited to):

  • Slips, trips, or falls from your bike or on uneven, steep terrain/environment
  • Collisions with natural features (rocks, trees, roots, rivers, etc.) or other riders.
  • Weather-related risks such as rain, wind, heat, or rapidly changing conditions.
  • Mechanical failure of equipment, despite regular maintenance.
  • Physical exertion that may result in fatigue, dehydration, or medical events.
  • Remote locations that may delay medical treatment or emergency response.
  • Collisions with vehicles on public roads and state highways. NZ drives on the left-hand side of road.
  • Dogs and other animals such as stock on trail.
  • Train movement and train tunnel.

Your Responsibilities as a Rider:

  • Please refer to and read the trip description and determine your bike riding competency level to match the appropriate trip selected.
  • Follow all instructions given by your tour leader at the safety briefing and at all other times during your tour.
  • Follow all accommodation, other activities and venue site rules and safety protocols.
  • Wear the safety equipment supplied (helmets at all times and any other protective gear as instructed.
  • Ride within your personal skill and fitness level.
  • Disclose any medical conditions or limitations that might affect your ability to safely participate in the activity.
  • To carry personal medication as required.
  • Respect other participants, road and trail users.
  • Comply with all local traffic laws and regulations,
  • To respect the natural environment and local communities during your trip. This includes no littering, disturbing wildlife, or damaging natural or cultural resources.
  • To report to us as soon as possible any damage to bike and equipment.
  • Responsible for your personal belongings during the trip. The tour operator is not liable for lost, stolen or damaged items.
  • You confirm that you are physically and medically able to participate in this bicycle tour. You have not been advised against cycling by a health professional.

Your Responsibility for Group Bookings and under 18 year olds:

  • These terms and conditions apply to each participant included in the group booking.
  • Where a booking is made for two or more people, then each participant in the group must be made aware of and accept these terms and conditions.
  • You accept responsibility for the supervision and the compliance of these terms and conditions for under 18 year olds in your group.

Our Responsibilities as the Tour Operator:

  • To comply with the Health and Safety at Work Act 2015 and take reasonably practicable steps to ensure your safety.
  • Provide well-maintained equipment and protective gear, including reflective vests, lights and helmets.
  • Deliver a thorough safety briefing before departure.
  • Monitor conditions and adjust the activity if risks become unacceptable.
  • Have emergency procedures in place, including access to first aid.
  • For the safety of rider/s and others, we reserve the right to exclude a person from a trip at any time if in the opinion of the tour leader or operator, that the person is likely to risk the health, safety of comfort of other clients, or themselves through their behaviour. In such circumstances, we will not be obliged to offer any refund or transfer of booking.

Medical Conditions:

It is your responsibility to inform us of ANY condition that may affect your health. If you require prescription medicines, please carry them with you. Please indicate on your booking if you have any of the following medical conditions:

  • High blood pressure
  • Vertigo
  • Recent Surgeries
  • Anaphylaxis responses to allergies
  • Heart disease
  • Diabetes
  • Epilepsy
  • Others – please tell us

Emergency services response

To ensure proper care in the event of an accident or illness, if you are on any medication or you have any allergies or reactions to any medications please provide details on your medical form.

Weather:

Adverse weather conditions may mean that planned activities can’t proceed as intended. A decision to change an advertised trip based on the weather conditions will be made by us at the time and is made in the best interest of you and your safety. We and/or their contracted suppliers can’t be held responsible for any changes as a result of the weather.

Cancellation Policy:

Self guided trips operate rain or shine, however, we reserve the right to cancel or modify the trip for safety reasons, such as severe weather conditions. In the event of cancellation by us, you will be given the option of rescheduling or receiving a refund.
